Terms and Conditions

These General Terms and Conditions constitute a legally binding agreement between Gulf Shipping Limited and its Customers. By accepting a quotation or allowing the Company to provide services, the Customer agrees to the following key provisions:

Customer Responsibility – The Customer warrants ownership of the goods or full authority to act on behalf of the owner and accepts these conditions on behalf of all interested parties.

Third-Party Services – Unless expressly instructed in writing, the Company will use reasonable care in selecting third-party service providers but assumes no liability for their actions or omissions. All claims relating to third parties must be made directly against those parties.

Charges & Payment – The Customer is unconditionally responsible for all freight, duties, and related charges, regardless of any arrangement with agents or other parties. Payment is due as agreed or upon release of cargo documentation. Late or unpaid sums may incur finance charges, collection costs, and handling fees.

Lien & Disposal Rights – The Company retains a general lien over all goods and related documents for any outstanding amounts. After giving notice, the Company may sell or dispose of goods to recover sums due, with storage and other costs accruing to the Customer’s account.

Accuracy & Compliance – The Customer must provide accurate information and ensure goods are properly packed, labelled, and compliant with all applicable laws and regulations. Dangerous or prohibited goods will not be accepted without
prior written consent.

Insurance – No insurance will be effected unless expressly requested and confirmed in writing by the Company.

Liability Limitations – The Company is liable only for loss or damage directly caused by its proven negligence and is not responsible for events beyond its control, including delays, force majeure, or the actions of third parties.

Governing Law – These Terms and Conditions shall be governed by and construed in accordance with the laws of Trinidad and Tobago.

Full terms, including detailed rights and obligations, are available upon request and shall take precedence over any conflicting provisions contained in shipping documents.
